Welcome to NYC Pro Tasker! By accessing or using our services, website, and mobile applications (collectively, the "Services"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.
1. About NYC Pro Tasker
NYC Pro Tasker provides on-demand labor, moving help, furniture assembly, TV mounting, power washing, and other home and commercial services ("Services"). Our platform connects service providers ("Pros") with customers ("Clients"). Pros are independent contractors, not employees of NYC Pro Tasker. NYC Pro Tasker is a platform that facilitates connections; we are not responsible for the acts, omissions, or conduct of any Pro.
2. Acceptance of Terms
By using NYC Pro Tasker, you agree to: • Comply with all applicable laws. • Provide accurate and complete information. • Treat all Pros, Clients, and others with respect.
3. User Accounts
• You must create an account to use certain Services. • You are responsible for all activity under your account. • Keep your login credentials secure and notify NYC Pro Tasker immediately if your account is compromised.
4. Booking and Payment
• Service pricing is displayed on the platform. • Payment must be made via NYC Pro Tasker unless otherwise agreed. • Cancellations and refunds are subject to our Cancellation Policy.
5. Code of Conduct & Prohibited Activities
You agree not to: • Harass, intimidate, or discriminate against others. • Use Services for illegal purposes. • Misrepresent your identity, credentials, or qualifications. • Damage, misuse, or interfere with NYC Pro Tasker systems. Violations may result in account suspension or termination.
6. Safety & Insurance
• Clients and Pros are responsible for their own safety during Services. • Pros may carry insurance, but NYC Pro Tasker does not guarantee coverage beyond the limited Property Damage Coverage described below. • You should verify any insurance or liability protection directly with the Pro.
7. NYC Pro Tasker Guarantee – Property Damage Coverage
Limited Property Damage Coverage: NYC Pro Tasker provides coverage for accidental property damage caused by Pros during a service, up to a maximum of $1,000 per service incident. Coverage applies only to direct, accidental damage to Client property. It does not cover: • Pre-existing damage • Wear-and-tear • Damage caused by gross negligence, intentional acts, or illegal activity • Damage caused by Clients or third parties unrelated to the Pro Clients must report damage within 48 hours of service completion, including photos and repair estimates. NYC Pro Tasker reserves the right to investigate and approve claims before reimbursement.
8. Limitation of Liability
Important: By using NYC Pro Tasker: • NYC Pro Tasker is not liable for any injury, property damage, loss, or other claim caused by Pros or Clients outside the limited Property Damage Coverage. • Maximum liability for any claim is limited to the total fees paid for the specific Service giving rise to the claim. • Clients acknowledge the inherent risks in using on-demand labor services and agree to assume all responsibility for such risks.
9. Independent Contractor Acknowledgment
• Pros are independent contractors, not employees of NYC Pro Tasker. • NYC Pro Tasker does not control how Pros perform services. • Pros are responsible for their own equipment, taxes, insurance, and compliance with applicable laws.
10. Arbitration Agreement & Class-Action Waiver
Legally binding arbitration and waiver provisions: Mandatory Arbitration – Any dispute, claim, or controversy arising out of or related to these Terms or the Services shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA). Arbitration will take place in New York, NY. Class-Action Waiver – Any arbitration will be conducted only on an individual basis. You waive the right to participate in any class, consolidated, or representative proceeding. Opt-Out Right – You may opt out of arbitration by sending written notice to support@newyorkprotasker.com within 30 days of first using the Services. Limited Remedies – The arbitrator may award only individual relief consistent with these Terms; no punitive, exemplary, or class-wide damages are allowed.
11. Intellectual Property
All content, logos, and materials on NYC Pro Tasker's website and app are our property or licensed to us. You may not copy, reproduce, or use them without permission.
12. Termination
NYC Pro Tasker may suspend or terminate your account for: • Violations of these Terms • Suspected fraud or illegal activity • Any activity that threatens the safety or integrity of the platform
13. Privacy
Our Privacy Policy explains how we collect, use, and protect your information. By using NYC Pro Tasker, you agree to our privacy practices.
14. Changes to Terms
NYC Pro Tasker may update these Terms at any time. The latest version will always be posted on our website. Continued use of Services constitutes acceptance of any changes.
15. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles.
